Child support payments can be garnished from your Title II benefits. A family court can enforce child support payments and arrears from retroactive and current benefits. SSA POMS section GN 02410.215 (A3) allows garnishment by state court order. Depending on the disabled worker’s circumstances, the Court can order the garnishment of anywhere from 50%-65% of disabled individual benefit checks from the current monthly period. SSA will not garnish Supplemental Medical Insurance Premiums or Medicare Benefits.
