For individuals coping with severe intellectual and developmental disabilities, the toll these conditions take can be just as significant as any physical impairment or disability. Adults who have worked and contributed to the Social Security system, and who have long-term intellectual disabilities that now prevent them from working, may be eligible for Social Security Disability Insurance (SSDI) benefits from the federal government. The Law Offices of Sheryl Gandel Mazur is a dedicated legal advocate for these individuals and their families. Our experienced attorney knows how frustrating a benefits claim can be, especially when it is initially denied. We are here to use our experience to help those with intellectual and developmental disabilities get the SSD benefits they need.
SSD Benefits for Intellectual & Developmental Disabilities in New Jersey
SSDI eligibility for developmental disabilities requires that the impairment must have manifested itself or had an onset date before the age of 22. There are four categories that determine eligibility for SSDI benefits; meeting any one of these typically establishes eligibility. They are:
- Mental incapacity evidenced by dependence on others for personal needs (such as bathing, dressing or eating) and the inability to follow directions
- A valid verbal, performance or full-scale IQ at or below 59
- A valid verbal, performance or full-scale IQ between 60 and 70, and a physical or mental impairment that imposes additional work-related limitations
- A valid verbal, performance or full-scale IQ between 60 and 70 that results in marked restriction of activities of daily living; marked difficulties in maintaining social functioning; marked difficulties in maintaining concentration, persistence or pace; or repeated episodes of decompensation, each of extended duration (must demonstrate at least two of these)
